How Non-Drowning Pool Accidents Happen
An accident at a pool may support a premises liability claim, which concerns a property owner’s responsibility for unsafe conditions, or a claim involving defective equipment. The legal questions depend on where the incident occurred, who controlled the pool, and what caused the harm.
Swimming pool accidents may involve:
- Diving injuries: Entering shallow water can cause head, neck, or spinal injuries.
- Wet pool deck falls: Slippery surfaces, poor drainage, or damaged decking may contribute to a fall.
- Drain and suction entrapment: A swimmer’s hair, clothing, or body can become trapped by a drain or suction system.
- Chemical injuries: Improper chemical levels or handling may cause respiratory, skin, or eye injuries.
- Defective pool equipment: Ladders, diving boards, filters, pumps, drains, and other components may present safety concerns.
These incidents can occur at a private residence, community pool, apartment or condominium complex, hotel, or another property open to residents or guests. Depending on the evidence, responsibility may involve:
- A homeowner, homeowners association, or property operator
- A pool contractor or maintenance provider
- An equipment manufacturer
The analysis may turn on property conditions, supervision, and equipment design or performance.
Preserving Evidence After an Accident
Prompt investigation can help document the pool area before repairs, maintenance, or routine activity changes it. Photographs and video may show the deck, water depth markers, fencing, gates, drains, warning signs, or equipment involved. Incident reports, maintenance records, surveillance footage, and witness information can provide additional context.
We base our assessment on the available evidence. In appropriate fall cases, we may visit the location and document relevant conditions with photographs and measurements.
Florida Residential Pool Barrier Requirements
Florida’s Residential Swimming Pool Safety Act appears in Chapter 515 of the Florida Statutes. For final inspection, a new residential pool must have at least one qualifying safety measure. The available measures include:
- A compliant pool barrier
- An approved safety pool cover
- Exit alarms on doors and windows providing direct pool access
- A self-closing, self-latching device on doors providing direct pool access
- A qualifying pool alarm that meets applicable standards
A compliant residential pool barrier must be at least four feet high on the outside. It must be configured to prevent a young child from crawling underneath, squeezing through, or climbing over it. Determining whether a barrier or safety feature complies requires examining the property, construction date, and applicable law.
Chapter 515 applies to residential pools at detached one-family or two-family dwellings and certain townhouses. Public pools are regulated separately. A safety requirement may be relevant evidence after an accident, but it doesn’t establish responsibility by itself.
Deadlines & Damages in Florida Pool Claims
For most Florida negligence-based personal injury claims accruing on or after March 24, 2023, the filing deadline is generally two years from the injury date. Claims accruing before March 24, 2023, generally remain subject to the prior four-year deadline. Florida wrongful death claims generally have a two-year deadline measured from the date of death.
Exceptions and other legal rules can change which deadline applies, so each incident must be evaluated individually. A claim may seek compensation for medical costs, lost income, and pain and suffering when those losses are supported by the facts and available legal remedies.
What to Expect from Our Claim Process
A free initial telephone consultation gives you an opportunity to describe the incident and ask questions without committing to representation. If we accept the case, our work may include accident investigation, medical coordination, insurance preparation, and ongoing client updates. We generally advance case costs.
We can help connect clients with doctors who may wait for payment until the case concludes. When an insurance company requests a recorded statement, we prepare our clients beforehand and participate as appropriate. We explain the questions likely to arise and the importance of providing accurate information.
Our attorneys can provide trial representation when a case requires it, but not every claim proceeds to trial. Clients retain the right to accept or reject a settlement after receiving our attorneys’ advice.
