Our client was the passenger in a vehicle traveling on the Palmetto Expressway, when it struck a stalled unlit tractor trailer and killed our client and the vehicle driver as well. About an hour earlier, another individual driving on the Palmetto almost crashed into the stalled unlit tractor trailer, so he called 911 and was transferred to the Florida Department of Highway Patrol and notified the dispatcher that the tractor had no lights or warning signs. Unfortunately, an officer was not dispatched to the scene and ultimately resulted in the wrongful death of our client. The jury awarded $8.9 million for the case, which at the time, was likely the highest jury verdict in Florida for one parent for the death of an adult child. Unfortunately, the jury’s verdict was reversed by the Florida Supreme Court in a 5-2 decision, with the court holding that the Florida Highway Patrol owed no duty to the parent of the woman who was killed.
