Federal Tort Claims for Personal Injuries Caused by the U.S. Federal Government

In most instances, lawsuits cannot be brought against the federal government for its actions or inactions under a theory of law known as sovereign immunity. However, in 1946, the legislature carved out an exception to this immunity from suit known as the Federal Tort Claims Act. Under this act, civil suits can be maintained against the United States for the negligent actions of federal government employees which cause loss of life, physical injury, or property damage.

Claims under the Federal Tort Claims Act that we may handle include:

Personal injury lawsuits brought under the Federal Tort Claims Act are also tried before a federal judge, not a jury, in a process known as a bench trial.
