Federal Tort Claims for Personal Injuries Caused by the U.S. Federal Government

In most instances, lawsuits cannot be brought against the federal government for its actions or inactions under a theory of law known as sovereign immunity. However, in 1946, the legislature carved out an exception to this immunity from suit known as the Federal Tort Claims Act. Under this act, civil suits can be maintained against the United States for the negligent actions of federal government employees which cause loss of life, physical injury, or property damage.

Claims under the Federal Tort Claims Act that we may handle include:

  • Car accidents involving federal government vehicles such as the United States Post Office mail trucks or military convoys
  • Premises liability suits for slip and falls or other incidents caused by dangerous conditions on federal property
  • Other negligent actions by federal government employees that cause personal injury
  • Catastrophic Medical malpractice claims against VA hospitals and health care providers

Although the U.S. government has provided this avenue to file suit for personal injury damages, it also requires strict compliance with the procedural rules that govern bringing such a suit. For instance, there is an administrative process that must first be pursued which allows the government to review the claim before any lawsuit may be filed. Personal injury lawsuits brought under the Federal Tort Claims Act are also tried before a federal judge, not a jury, in a process known as a bench trial. The complexities of claims under the Federal Tort Claims Act should be addressed by an attorney experienced in handling federal lawsuits and personal injury claims.
