When your family member is a drowning victim in Broward County due to the negligence of another, you need a reliable attorney that will do his/her best to seek compensation for the injury (or death). We recently settled a case for a family of a woman who was on a catamaran on a dive trip when the boat capsized here in Pompano Beach, Florida when the boat encountered rough waters as it entered the Hillsborough Inlet following a dive trip.
The bulletin below by NBC 5 local news reported the Broward Sheriffs’ Department, the coast guard, and Ft. Lauderdale Police were all at the scene to rescue the passengers. In addition, witnesses near the scene of the accident reported that people from other boats rushed to the scene to help. One witness in particular captured a photo of one of the passengers on top of the flipped over boat attempting to pull people out of the water.
Another report by ABC News mentioned that it was a rogue wave that caused the 45 foot boat to capsize, sending all 23 passengers into the water. Four of the passengers were rushed to the hospital. Sadly our client was the only passenger that did not survive.
Our firm is located in Coral Springs and consists of 5 lawyers that work closely on each case. The head attorney, Dan Cytryn, has over 36 years of experience and oversees every case handled by the firm.
Since Florida is blessed with beautiful beaches and a plethora of swimming pools, spas, water parks, and theme parks, inevitably there is an increased risk of drowning to ourselves, our children and our families.
Approximately 260 children under the age of 5 drown in swimming pools each year and numerous others are injured in swimming-related accidents. According to the Florida Department of Health, Florida has the highest number of people ages 1-4 drown in the entire nation followed by Oklahoma and Arizona for this age group.
Drowning accidents and deaths are many times due to poor supervision of a babysitter, teacher, or chaperone. Other accidents are caused by defective safety equipment or cleaning equipment used in the pool. Many times houses or other premises carry liability insurance that will cover injuries sustained by drowning accidents.
Due to the high incidence of drowning accidents and injury in Florida, the state legislature passed the Residential Swimming Pool Safety Act statute 515.29 section 1a, which requires barriers at least 4 feet high around residential swimming pools.
Furthermore, the Virginia Graeme Baker Act is a federal law that imposes mandatory requirements for pools, spas and hot tub utilization of suction entrapment avoidance devices. Although some drowning accidents cannot avoided, the Florida Department of Health website discusses some prevention tips that are listed below:
Additionally the Florida Department of Health for Broward County provides additional safety tips including a reference for administering CPR and a list of facilities in every city in Broward County that offers water safety lessons.
