| In
the case of Dvorak vs. TGI Friday's, Defendant's
highest offer was $21,000.00 in the slip and fall case.
Plaintiff achieved a verdict of $248,000.00 and the case
ultimately went up to the Florida Supreme Court, upholding
the Fourth District Court's decision that the offer of
judgment (proposal for settlement statute) was constitutional,
and in addition to paying almost $300,000.00 for the
verdict including interest, TGI Friday's had to pay the
Plaintiff an additional $450,000.00 in attorney's fees.
This case established the law that the offer of judgment
statute was mandatory and constitutional. |
