Dan Cytryn

Attorney

Attorney Dan Cytryn is a licensed Florida attorney who has been practicing injury law for over 40 years in Broward County. He handles cases throughout all of Florida. He is a Board-Certified Civil Trial Lawyer in a state where only about 1% of trial lawyers practicing hold that title. He has now been Board Certified for more than 25 years.

Mr. Cytryn has been lead counsel in more than 105 personal injury jury trials, including motor vehicle accidents, slip and trip and falls, medical malpractice cases, nursing home negligence, and more. He has approximately 25 million-dollar verdicts or settlements in his career.

He is AV-rated by Martindale Hubbell and has a rating of 10 (out of 10) on Avvo.com, the highest rating a lawyer can attain. Mr. Cytryn has been named to the Super Lawyers list from 2010 to 2024 by Super Lawyers magazine. To be selected to the Super Lawyers list, an attorney must have a high degree of peer recognition, ethical standards, and achievement in their field. The magazine tries to select the best 5% of lawyers in the state of Florida, and those named by Super Lawyers Magazine are considered by them to be in the top 5%.

He has also handled more than 40 appeals, including having successfully argued the landmark case of TGI Friday's vs. Dvorak in the Florida Supreme Court. In that case, the trial judge found that the proposal for settlement/offer judgment rule was unconstitutional, and if it was not unconstitutional, it was discretionary. Despite Mr. Cytryn beating the proposal for settlement by around 400%, the judge denied attorney’s fees. TGI Friday’s appealed the jury verdict to the Fourth District Court of Appeals, and Mr. Cytryn handled the appeal for his client and won. Mr. Cytryn then appealed the denial of attorney’s fees under the then offer of judgment rule and statute to the Fourth District, and the court reversed. Mr. Cytryn then argued the case in the Florida Supreme Court and won. Throughout his career, he has argued a total of three times before the Florida Supreme Court.

In addition to arguing three times in front of the Florida Supreme Court, Mr. Cytryn is one of the few lawyers in the history of Florida who has been quoted by Florida Supreme Court justices in their written opinions. His Comment in opposition to the adoption of the Daubert standard for admissibility of evidence was quoted by then-Florida Supreme Court Justice Barbara Pariente (DeLisle v. Crane Co., 258 So. 3d 1219 (Fla. 2018) (Pariente, J., concurring)), and also by Justice Jorge Labarga (In re Amendments to Florida Evidence Code, 278 So. 3d 551 (Fla. 2019) (Labarge, J., dissenting)). The justices noted:

The concerns raised by the Committee do not merely exist in the abstract. Attorney Dan Cytryn, a lawyer with “more than 35 years [of experience] almost exclusively in the area of personal injury,” urged this Court not to adopt the amendment because Daubert has made “complex and moderately complex cases ... more expensive to try.” Comment by Dan Cytryn at 1, In re Amends. to Fla. Evidence Code, 210 So.3d 1231 (No. SC16-181). Cytryn explained that, after Daubert, his law firm “has taken a much closer look at cases that are meritorious, and perhaps are worth under $100,000, but require litigation. [They] have turned down several meritorious cases because of the additional costs and time restraints that Daubert implicates.” Id. at 2. While the impact on the workload of the trial courts or the difficulty in finding a lawyer should not be the sole consideration for determining whether a rule of procedure should be adopted, if adoption of the rule is at the expense of litigants' constitutional right to access the courts, then the impact on the workload provides a compelling reason to reject the rule.

When Mr. Cytryn was asked about his career a few years ago, he said: "I really love what I've been doing for the past 35 plus years. I've been helping people better their lives, helping make this country a safer place, and basically, I love making the insurance companies pay. I have a personal dislike for insurance companies. I don't even like the fact that they're allowed to be called ‘insurance companies.’ They should be called ‘take your money companies. That's because what they do is, they take your money, and then don't want to give it back when they should. So that's where I come in."

Mr. Cytryn is a graduate of the University of Miami, having received a bachelor’s degree in business administration in accounting in 1978. He graduated from Nova Law School in Fort Lauderdale in 1981.

Mr. Cytryn was president of the Broward County Trial Lawyers Association in 1995 and was an officer in the organization for many years before that. Previously, he served as the Head of Case Evaluation for attorneys for the organization from 1990 to 1991.

Mr. Cytryn is a member of the American Board of Trial Advocates (ABOTA), a nationwide organization with 6,000 trial attorneys. In order to become a member of ABOTA, a trial attorney must be invited to join, meet strict admission requirements, and have been deemed by the organization to have a high level of integrity and personal character.

Mr. Cytryn has been appointed by the President of the Florida Bar to the Florida Bar's Civil Procedure Rules Committee and has served on that committee now on and off for more than ten years. The Civil Procedure Rules Committee makes the rules governing the procedure for civil court proceedings which must be followed by all judges and lawyers.

Mr. Cytryn has been an E.A.G.L.E. for the Academy of Florida Trial Lawyers, now known as the Florida Justice Association, for over 20 years and is a frequent fundraiser for the organization. E.A.G.L.E. members' contributions directly benefit primarily consumers and further the cause for individual rights. In the year 2015, he received the E.A.G.L.E. legend award for having contributed at least $100,000 to the Florida Justice Association.

What Makes a Successful Trial Lawyer:

When Mr. Cytryn was asked a few years ago what makes a trial lawyer successful, he said, "You have to be intelligent, super quick, on your feet, dedicated, hard-working, loyal, and care about people. You must surround yourself with a top-notch staff.

I find when I'm in the courtroom often I move and think twice as quickly as the younger lawyers. Maybe it's my experience, maybe it's my intensity, or maybe it's my type-A personality. It may cause me to butt heads with some judges, but you can't be saying "yes ma'am" all the time and be successful. You must be a student of the law. I have been a student of the law since I started law school about 38 years ago. I love the law, still reading periodicals, starting cases, keeping up on wireless service, so I can be up to date on all the latest issues.

I still probably average close to 50 hours per week at the office, and when in trial, it's probably closer to 70 hours per week.

In order to be a successful trial lawyer, you have to work hard; put in a lot of effort, time, and stay updated.
